Has China Established a Green Patent System? Implementation of Green Principles in Patent Law

The goal of high-quality economic development proposed by China has defined the sustainable concepts innovation, coordination, green, openness and sharing. Changes in strategies affect corresponding changes legal system. green patent system an important impact on development. This paper looks for evidence at level from three aspects application protection, licensing infringement relief, proves penetration principle system, which is mainly reflected following points: (1) terms application, concrete public interest clauses, exclusion non-green technologies patentable objects, open channels technology applications to speed up examination; (2) licensing, exploration compulsory patents environmental improvement encourage sharing patents; (3) remedies, introduction appropriate time limit right stop claims, punitive damages intentional serious damage ecological environment. conclusion that currently working establish a framework, but specific details have yet be perfected, legislative remains seen. above steps gradually established preliminary structure patents.
